By accessing or using the Markbase API ("Service"), you agree to these Terms of Service. The Service is operated by Rad Soft Inc. ("we", "us", "our"). If you do not agree, do not use the Service.

2. Service Description

Markbase provides a REST API for searching, filtering, and retrieving U.S. trademark data sourced from the United States Patent and Trademark Office (USPTO). We do not guarantee the accuracy, completeness, or timeliness of the data.

3. Plans and API Keys

The Service offers multiple tiers: Open (free, no key required), Launch, and Scale. Paid plans include an API key for higher rate limits and search result caps. API keys are personal and must not be shared or published publicly.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to circumvent rate limits or access controls
Resell or redistribute raw API data as a competing service
Overload the Service with excessive requests beyond your plan limits
Use the Service to scrape or harvest data in bulk without authorization

5. Data Source

Trademark data is sourced from publicly available USPTO datasets. We are not affiliated with, endorsed by, or sponsored by the USPTO. The data is provided "as is" without warranty.

6. Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

7. Limitation of Liability

To the maximum extent permitted by law, Rad Soft Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. You may stop using the Service at any time. Upon termination, your API key will be revoked.

9. Changes

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify users of material changes via the website.
